4yrs or 5yrs to ILR?

Got my HSMP in sept 05.

Changed to WP in Nov 06 and now on Tier 1 (HSMP).

Do i qualify for ILR in 4years or 5 years.

Can someone please advice.

I'm i covered by the recent judicial judgement of April 09.

looks like you have done a full circle there.
Question: Why did you change to WP from hsmp. Your reason for changing might offer some hope. When you changed 'back' to tier 1 (hsmp) is this based on the first JR

i changed from hsmp to work permit in Nov 2006 due to the 07 Nov changes by the HO.

i held the work permit until May 08 and then changed back to Tier 1 (HSMP). The Tier 1 (HSMP) is not based on the first JR. Its based on the new points system.

Will i have to make a change based on the first JR to be covered by the second JR.

where do i stand with the ILR.

I have a somewhat similar mix of WP/HSMP.
- in the UK on WP from Jan 2005
- switched to HSMP in April 2006

Can I apply under the 4-year changed rule for HSMP when it becomes available on May 20th?

This is another mess created by HO themselves by imposing rule with retrospective effect. As a original HSMPian you should be given 4 years qualify facility by HO.

But, you have to wait till 20 May '09. See what kind of remedy HO will give !

you should be covered by 2nd JR, but it is not a straightforward case. it would have been easier if you switched back due to 1st JR. wait for the new guidelines. if UKBA refuses to give you ILR after 4 years, contact HSMP forum.

in fact, UKBA should reimburse you for all your in-country switching fees. but that you would have to do as an individual claim and would take ages to process.

Can someone advice on where i stand with the home office's policy released yesterday.

Do i still qualify for 4years ILR under the ILR review judgement or i have to switch back to the original HSMP status as per the 1st judicial review.

...any possibility of a refund of my costs for switching categories?

Background:
The 2nd reading of the new Borders Citizenship & Immigration Bill takes place on 2nd June 2009. The Bill will make it harder for migrants to settle in the UK.
The Govt. made clear that it intends to apply the harsh changes to migrants already in the UK. We are fighting to ensure that the new Bill does not affect those already here with Limited Leave to Remain.

How does it effect?
At the time the changes, anyone with Limited Leave to Remain in the UK.

How can you help?
WRITE to your MP (via letter or email). Please ensure two things:

1. Print and enclose (or attach if emailing) the briefing located at:

2. Write a brief cover letter explaining your concerns. i.e. explain how it would affect your life if the new rules are applied retrospectively and increased the time it takes for you to become settled in the UK (i.e. get you permanent residence or citizenship). In other words, a brief hardship statement.

Deadline:
2nd reading is Tuesday 2nd June 2009.

If you haven't already written to your local MP about this, please do so now.
