Tier1(G) dependent query-very sensitive

Dear All,

I have sensitive query.

My friend has Tier 1 visa recently. she has a kid from previous relationship( live-in, no valid marriage ). But now married fresh, wants to bring spouse n kid( depenendent) on tier-1 dependent visa.

In this case, kid is completely dependnet on the my frd and kid has both mom and step parent's name in her passport. As there is no valid marriage in her 1st relationship, my frd does she has to produce any documentation?. something like affidavit saying that there was no valid marriage existed( the kid's birth certificate has the name of biological father, but kid's passport has the new dad's name)

They will be applying for the dedendent visa in may 09.
Pls advise.
