Dear All,
I am jsut nearing 4 year completion of WP. I came to UK in 15th August 2001 in Business VISA and I got my WP Stamped on September 14th 2001.
During this 4 Year Period, I was away for 3.5 months (between 13th April 2002 and 30 July '2002). This trip was business reason. I can get the letter from Employer stating that this was business trip.
My Query:
1. When I would be elgible for ILR (3 Year 11 months) ( Would it be Mid July or Mid August 2005)
2. Do I need a 2 separate letter from employer, one for supporting my ILR application and one for supporting the 3.5 months absence or can I have 1 letter combining both of the above.
3. What contend HO expect in the letter that support my 3.5 months absence.
4. I was not paid any salary during the 3.5 months absence here because I was working in India during that time. so no NI Contribution made during this period. Would this be any problem for my ILR?

The lack of response could be due to this being a repetitive question. With respect have you made any effort to search the forum?
1. 28 days before 14 SEP 2005.
2. Doesn't matter as long as both details i.e. absence and ongoing employment clearly addressed.
3. Why you were absent to include nature of duties, why you were selected, duration and that you were still in company employment at the UK branch/office over that period hence absence a secondment.
4. This indicates that there may be a break in employment and hence impact on WP timeline - was this the case? On what contract were you - UK or overseas?

Regarding the Point 4
- There is no break in my employment and no break in my WP as well.
- During my 3.5 months absence WP was Valid and I came back to UK on the same WP.
- My company is a Indian based company having a branch in UK. Our WPs are processed as Intra Company Transfer category.
- The fact that I was getting Indain Salary during those 3.5 months period and that's the reason no NI contribution during that period. Would this affect my ILR ?
Does my explanation is clear enough?

Based on this clarification ILR application should be successful pursuant to submission of all required documentation.

Dear Members, Modrators
I am getting a letter from my employer, to support my 3 months and 15 days absence form the UK for the 4 Year WP and here is the content of the letter that I plan to get it from my employer.
[b]During his employment with us, Mr. XXXX was away from the UK for a period of 3 months and 13 Days (From April 14th 2002 till July 28th 2002). During this absence, Mr. XXXX continued his work in our Indian branch office and his employment with the UK Office was continued during this period. Mr. XXXX resumed his duty in our UK office from 29th July ‘2002 and after this Mr.XXXX is not away for more than 4 Weeks from the UK in any one year.[/b]
The content above is sufficient or should I need to change/add more info with regards to my absence?
Your inputs would be highly useful to get the right kind of letter from my employer.

Tickle, it looks to me that the proposed wording from your employer fully explains the 3.5 month absence.
One final point ... stop panicking! As Kayalami said "Based on this clarification ILR application should be successful pursuant to submission of all required documentation."
Just go for it!

Dear Kayalami, John and other members,
Thanks for all your support on my queries. Today I have got ILR from Croydon PEO.
I had 3 months and 15 days absence from the UK for business reason . My employer supported this absence.
Immigration officer satisfied with the employer letter. They did n't look any other evidence like Bank Statements or Pay Slips. After 2 hrs I got my Passport back with ILR Stamp on it (Including my dependets (wife and son)).
