EU FAMILY MEMBER RESIDENT APPLICATION IN LITHUANIA?????????

Post by El shaddai » Thu May 28, 2009 2:31 pm

Has anybody got a clue about what the european law says.A friend of mine is a non eu national but married to an EU Citizen from Lithuania in ireland.he s got EUFAM 4 in ireland for five years base on their marriage.they decided to apply for the same EU Treaty Right Application in Lithuania after submitting loads of documents and it takes about 11 months for them to make a decision but at last to his suprised instead of him to get 5 years residence card, he was given 1 year and need to be renew every year till 5 years. He asked them why 1 year and not 5 years?but they said he is subjected to their own law and not Eu law.Now he need to resubmit each year same documents for renewer of the residence card.Is this normal?is that what the Eu law says?could this be an act of beloved or hatred? What can he do to fight for his right?every little contribution will be appreciated.

Is your friend residing in Ireland or Lithuania? Because if he is not residing in Lithuania why would they issue him with a RC?

Anyway I think as his spouse has been living and working in another EU state he should be considered and issued with a RC in accordance with EU law but lots of countries tend to process their own nationals under national law!

Your friend should contact SOLVIT? Or make a complaint to the European commission?

Not that im advising you to do this but when I lived in Vilnius I found immigration very difficult to deal with. Managed to get things sorted very quickly by greasing a few palms. Its almost expected. Very corrupt officials. Cant tell you how many times I was pulled over for non existent traffic offences where the police almost expected a pay off!

Apologies.

What I mean is, why does your friend feel he needs and is entitled to a Lithuanian Residence Card, when he doesn't reside in Lithuania?

I answered in the Europe forum as that one might be more suitable.

Hi Benifa, you dont need to resides permanently in any member states to get a RC as long as you gonna resides more than 3 months,as a family member of a citizen you are qualified to apply for a temporary resident card So your question is out of point.

Thanks to you all that have contributed and the message has been passed to the concerned person.
