Spouse visa holder leaving uk and returning back

Dear all,

My partner is holding a spouse visa. She have went back to her home country for more than a month and is going to return to uk next week. Since last time she was travelling with me together when she first entered into uk, there were not much questions asked by the immigration control.

However, she was a bit worried this time as she has left uk for over a month and there is also another problem here because the visa application stated that the sponsor should be able to financially support both's living, in fact, I am umemployed now and claiming benefits (JSA and housing). Will they ask her about the status of me? If so, should she be honest and tell them we are actually living on benefits... Can they check the details? And why she has left for that long? We are getting nervous if they will refuse her entry. Please could someone give me some advice? Thanks a lot!

Where a person is returning from a temporary absence abroad, like the above example the person can only have their leave cancelled under Paragraph 321A of HC 395, further guidance can be found in the continuing leave section here.
