illegal want to leave the country to apply from outside

Post by abidjan1 » Thu May 28, 2009 2:15 pm

hi everyone

i am an ILR holder and i am the process to marry my aprtner who is here illegally but she is known to Ho as she has an application with the HO using form FLR(o) on humanitarian ground.the Ho has accepted the apllication as valid but no answer since (10 months now).
i have been advice that when married the best option was to leave the country and apply from her home country.
How to leave the country? is she going to be in trouble while leaving the country?
i need your help

Shouldn't be a problem leaving. What nationality does she have? Are you both over 21?

I do not understand the original question.

Will her FLR(o) application continue after she has left the country?

Is your goal to get married in Africa? If so, what is she then going to apply for and where?

I think it is worth being very careful. You say your question is just about where to get married, but you also need to consider implications for your current application, and the requirement to do additional future applications?

If you stay in the UK, are you sure it will be a very difficult process? Would it have any impact on your existing applications?

If you leave the UK, would it have any impact on the existing application? Will you be able to just return to the UK, or will you have to do new applications to achieve that?

when she lodge her application i was not involve she has been advice to do so by an immigration adviser because she has a child from me.
but the thingis if we are married she does not need to be considered under the previous claim(compassionnate) but i think she should then be considered as a spouse of a settle resident.
I was hoping from this forum to be advise on procedure to achieve this aim.
i think i will contact an adviser and see what the rules are.
thank you all
