Spouse Visa

Post by malhoto » Fri Aug 26, 2005 4:53 pm

I am on work permit and my wife is having ILR. She got ILR in 2002 as she was married to some british person and then broke up . We got married in August,2005. My Work PErmit visa is going to expire on 29 October,2005. I am working with the same employer who gave me work visa.
My question is How sson can I apply for Spouse Visa.
I have checked the FLR(M form and it says I can not apply 28 days before the qualifying period of the application. What does that mean.

Pls help.

opi.

Opinder, well let's put it this way. I know this is not your circumstance but I think it gives a good clue as to the answer to your question.

If someone is granted a six-month fiancé(e) visa abroad and then comes to the UK to get married, as soon as that marriage has happened they can use the form FLR(M) in order to apply for their two-year spouse visa. That is, they do not need to wait until the last 28 days of validity of the fiancé(e) visa before applying for the spouse visa .... they can apply as soon as the marriage has happened.

So I also think that you personally are entitled to apply for your two-year spouse visa using the form FLR(M) now that the marriage has happened. I don't think there is any reason to wait until near the end of your current employment visa.

Presumably you had to apply for a Certificate of Approval to Marry in order to get married in the UK?
