Need Advice - Employment gap and ILR for Tier 1

Hello,

I am due to apply for ILR in March 2010. I have spent time in UK on work permit, HSMP and then on Tier 1 since April 2005. I have been in UK continuously with same employer since April 205. However, I am going to be made redundant next month. Since it is hard to find another job, I am thinking of other options under self-employment.

Can someone help me with :

1) if I start a company of my own, how much will I need to earn by Feb 2010 to apply for ILR? If I make a loss or donot get enough business in worst case scenario, how do I qualify to show economic activity? Will any investment made o employment given work as economic activity?

2) My wife is a contractor 9has limited company) and is still earning. If she employs me as a business development manager, will that count as a proper employment for ILR purposes?

Any legal advice on best option here will help.

There is no hard and fast role that u must earned that much to get ILR
u mut be economically active
1. enough income which can covered ur expenses atleast
2. Wife is ur dependent, so i donot think bus dev mng in ur spouse's company is very good idea, pl take legal advie on tht option.

Regarding the first option, if I setup my own company I can definitely try hard to get some work and show evidence. If I get some work, I can show some revenues for my company. However, if I don't there will be just loss to the company.

Regardless, I will definitely be able to how income for first few months of the fifth year where I have been in my current job. I also have sufficient funds for myself and my dependents which can take care of my redundancy period too.

So I assume setting up my own company will qualify me for my ILR. If I get some work, that would be an added advantage. Is that reasonable assumption?
