H1 B stamping

Post by mmhtn » Thu Sep 01, 2005 11:38 am

Hi,

I'll be going for stamping soon to London consulate. I recently got my H1 approved on MS degree holder quota. However I'm a bit concerned about the following situation

I did my MS from US with a very reputable university. I worked for 4 years. Then I moved to UK. However I didn't take care in collecting relieving letter from my US company. All matter were settled on email. I have other documentation like LCA filings, appointment letters however no such letter which would state the start and end date for my employment in US. Since I'm on MS degree holder quota, would it still create a problem.

Do you have from the US - pay stubs, IRS forms, Bank statements, Credit cards? This to show relevant periods of residence. Same for the UK? What of passport entry/ exit stamps? If it holds that you departed US on end date of prior employment which I am assuming was also on H1 then shouldn't be an issue. Even where for practical reasons you left shortly after said end date (within 10 days) then also o.k. - basically you should succeed if there is no bans in place for excessive overstays as per the INA.
