Tier one general Refused!

Dear All,

New to the forum.
I am writing my case history..


- I applied for Tier 1 (General) on 30th March 2009 in Uk.
- Got refusal on 4th June 2009.
- My IGS visa expired on 29th May 2009 (Could have extended this for one year , if i had received my documents earlier )

Reasons for refusal :

.I could not show the last month(March month) salary in my bank statement when i applied for the visa initially.Also i did not had the last month salary slip.But then i had a employers letter stating my earnings.

My company transfer the salary only on the last day of the month.And i applied before last day of the month without the bank statement and par slip.I have both of these now, and also a right to appeal..

Frankly tell me how much chances do i have if i make an appeal..>?

So basically , i do not have any LTR on me, but i have a right to appeal till 17th June.

Now what i want to know very honestly is
1.HOw much chance do i have if i go through the appeal.(I have all the salary slips and bank statements now) but i did not had these then..?
2.Can i apply for IGS extension irrespective of my visa expiry now..?

Don't want to sound pessimistic, but I'm afraid that you have very slim chances of getting it approved. Did you mention about your condition and explained it on cover letter to case worker. Because, technically, as per rules, I think case worker went by book and rejected your application on the grounds of shortage of evidence.

I'd advise you to contact some professional help from some immigration officer or lawyer. He might be able to represent and mould your case in your favour.

And regarding your IGS visa, again I'm afraid you would need to apply it from your home country. Home office has just given you rights to appeal against the refusal of your Tier 1 application and I don't think they would allow you to apply for any fresh applications from within country.

I'd strongly recommend you to get in touch with some professional lawyer.

I also think, caseworker went by book, and he/she is right to refuse you as per rules and regulations,

But i would say definitely go for appeal as you have all the evidence Now and you may be granted Tier 1 General.

Hi

Take it from me and I have some experience. Your chances of success are 90%.

Of course the caseworker went by the book and he did what most people would have done but that doesn't mean your case is not good; just that things didn't go right.

1. You didn't have payslips but you did have employer's letter.
2. I know there is a gap of one day and they can refuse it
on the basis of one day but this would be against the spirit
of law. For one thing, the guidance is based on policies and
policies keep changing. You have substansively proved
maintenance. For another, court can and mostly does
look both at law and equity. Equity means that even if
some thing is not legally as it should be, the requirements
of justice demand that this should be considered.

I am confident you will win it. Take a solicitor. Keep your paperwork ready and go for it.

I have some experience of courts and I can assure you your chances are 90%. I only give ten percent or less to the failure because of the one day difference. Let us not assume that just something in the HO guidance is so strict, one day would make all the difference.

And even if you don't get anything from the first court, go to the higher one.
