How can I retain my ILR?

Post by LoveUK » Sat Sep 03, 2005 8:43 am

Me and my wife were granted ILR in July 2004. We had to shift to India in Dec 2004 on personal reasons and I started working immediately in India for a US client. I now receive my indian salary. I have an active UK bank account. I do not have any property in UK.

I do not want to loose my ILR.

Does my visit to UK once with in 2 yrs since I left will retain my ILR status for next two yrs?

Does the visit need to be on a business reason?

Does both me and my wife need to visit.

Does working for a UK client in India for an indian salary will better my chances of retaining ILR?

Thanks in advance.

I think you need to be a bit careful here. You are entitled to use your ILR visa to "resume residence" ... using like a glorified visitor's visa might cause problems. So whilst you might get away with it once or twice you will not get away with the "proverbial one week visit every 23 months" forever.

And all this applies separately to your wife. It is no good just you making that "proverbial one week visit every 23 months" and expecting it to have any effect whatsoever upon your wife's ILR visa. She would also need to enter the UK.
