visa for my future husband (Italy or Belgium?)

Hello all,

My fiance' and I will be getting married in Senegal in 2 weeks. We'll then be coming back to London for a month (he also has a UK study visa which is due to expire in September) and then moving to Italy together in September, where I will be working and he will be continuing his studies (he has been accepted into a programme there). I'm Belgian, he's Senegalese.

I have contacted the Italian embassy in Dakar to get information on how to apply for a family member visa for him, but they told me that since I am not a resident in Italy yet, I will have to apply for a visa for my future husband through the Belgian, which will then allow him to travel/transit to Italy and eventually establish residence there. The Belgian embassy however, told me I need to apply through Italy, and that they can be of no help in this situation.

Can anyone help us to figure out where and for what type of visa we should be applying? Any help would be much much appreciated!

A free, speedily processed Schengen visa should be applied for at the Italian embassy in London.

Family member visa.

Incidentally, having entered Italy, your husband has the same rights as you do, with regards to employment and studies, which are the same as Italian citizens. These rights do not have to be applied for, they are acquired automatically by nature of his relationship with an EEA national who is exercising Treaty rights in Italy.

He should, within 3 months of entry, apply for a "Residence Card of a family member of a Union citizen". This will be valid for 5 years, subject to certain conditions*. After this time, permanent residence is acquired and the conditions are removed.

*subject to your continuing to be regarded as a person who is exercising Treaty rights, your family link being retained, your residence in Italy.

Wow, your case is trully complicated!

My thinking..

You have only 2 weeks in Se, so applying there does not make sense.
So, you apply in London.
Because you husband will not go to Bg at all, he needs to apply with the embassy of the country to which he will be traveling, so it would be Italy.
And if they ask there about you.. just tell them you already live in Italy, just to not confuse them with your Bg nationality.
Maybe you could pay a quick trip to Italy as soon as you return to Europe in 2 weeks and apply for your residency there, so you already have it when you apply for his.
