Traveling out of the UK while on valid Tier 1

Post by LondonLondon » Mon Jun 22, 2009 4:23 pm

Hi, My husband and I are currently living in London, UK and are both on independent (not spouse) Tier 1 visas. We have a family emergency for which we might have to travel out of the country for a couple of months. We would however not want this to affect our status in the UK in any way. Can you please confirm to us the time duration allowed for a Tier 1 holder to stay out of the country without losing / affecting the status in any way? I appreciate the help. Thanks,

Your Tier 1 status will not be affected by your travel abroad while on Tier 1. You will be able to enter the country till you have valid visa.

This could though affect your ILR status. You have to check what is the max. no of days you are allowed to remain out of the country.

For ILR (permanent residency) purposes, keep this trip under 90 days. And keep the total time out of the UK under 200 days in 5 years (some say 225). Otherwise, you can come back as long as your Tier 1 is valid, and can renew Tier 1 as long as you qualify for extension.
