ILR when to Apply?

HI there

I came to the UK on a working holiday visa in 2002 - 2004 when I switched to Work Permit 2004 - 2007, currently I am on a spouse visa ( Civil partnership to british citizen)

My current leave expires on the 7th of August 2009. My question is when is the right time to apply for my ILR?

If I am reading the forum correctly it's 28 days before your current qualifying period expires so that would mean 28days before 7th of August ? Correct? So the earliest is 10th July?

I plan on applying by post.

As the CP of a British Citizen, you can apply once you have completed 2 years' legal residency in this capacity. You do not need to wait until 28 days before your current visa expires.

You will need to have passed the Life in the UK Test.

Yes I understand that - but surely two years in this capacity is on the 7th of August when my current 2 year visa is up?

So I can't apply after this date as I would be illegal - so 28 days before is permitted?
