Tier 1 - traffic offence ground for rejection ?

Tier 1 - traffic offence ground for rejection ?

Hi Friends,

I have a traffic incident in the US - driving on a supsended licence - will this be automatic grounds for rejection ? Does any body know of such case.

Did you get a criminal conviction for this offence?

If yes, then you might have some issue else not a problem.

Thank you for the response. I did have to go to court and the sntence was a monetary fine - does this classify as a criminal conviction ?

I think you should declare this in your application. Since court found you guilty and you was asked for a monetary fine. Its better to declare in the initial application. Since this is not a very serious crime. People do drive without license in emergency. If you don't declare now, it can surface in HO verification. There are some precedences where people were granted initial visas but at the time of extension they were rejected due to these reason. Why take risk?

Besides,Why your license was suspended in the first place? This question could trigger doubt in case worker's mind. Obvoiusly you were not driving properly and then was banned from driving. Which looks like a serial driving offense?

Whatever it is better declare in application.Case worker should appreciate the honesty.

Thank you much for the reply. The license was suspended due to an unpaid speeding ticket (I was unaware that my license was suspended). Just wanted to know if such traffic incident would make me ineligible - i do not want to apply if I will be rejected.

Traffic violence is not considered as criminal offence, you don't need to mention in ur application as criminal offence.

The case in concern was went to court where person was found guilty and fined monetarily.

Not sure on the laws in US but this conviction wont harm your application as long as you declare it.

If you are unsure on the "Criminal record" even after you went to court.. better declare this offence on the cover letter.

I had driving conviction and 1 year driving ban, but my visa was approved as i declared the offence with details on the form.

Better declare it. Your visa can be turned down at the time of extension as happened with one member of the forum. You can search his thread.
Declaring it will not affect the outcome of application but not declaring it could.Also note HO has mentioned conviction in the guidances and not crimial records.
