Gap year in Tier 1 - Please guide

Post by mmpalam » Sat Jul 11, 2009 4:17 pm

Hi Guys,

I am on Tier 2 visa presently and going to apply for Tier 1 General this September and very hopeful that I will get it. However, I have plans to attend a one year course starting from this October (i.e. 2009) till October 2010 and then resume my job. My question is:

1) Does studying a one year course will affect my visa status?
2) Will it affect my further Tier 1 extension after three years?
3) Will it affect my ILR? Do we have to show 5 years tax/salaries when applying for ILR?

I will be very thankful for your guidance.

Regards,
mmpalam

You are supposed to be economically active while on Tier-1 or atleast be seen as endeavouring to do so. Taking up full time study is in contravention to your VISA conditions.

Tier1 is better than Tier2 to go for studies for sure..

2) Will it affect my further Tier 1 extension after three years?

problem only comes at the time of extension if you are not able to show enough points of ur earnings adn also that you have been working for more than 1year to claim uk exp points...

during extension u dont need to show ur previous tax payment proof (at present but things can change dramaticallly who knows??)

3) Will it affect my ILR? Do we have to show 5 years tax/salaries when applying for ILR?

Yes it will definetely effect showing your proof of being active as Push mentioned...

that is the reason UK have student visa's for.. cheers

you can study part time. Do full time work. If you need to study then dont tell them just show self employed & show business & tax.
