Change of tourist visa into student visa / seeking assylum

I am EU citizen from Denmark. I been married with my husband since 2004 he hold a Iranian Nationality. His application has been sent to the Home Office and we are waiting to receive his ILR, this time. Now my husbands brother came from Iran with tourist visa, to visit us, he is electronic engineer. Because of the social situation in Iran at this stage it is dangerous to return. Can he seek asylum and if so will he be able to study in UK and will he be considered as a home student? Will he get any financial help if he seeks asylum. I will also like to add that the regime in Iran have killed his father when he was 2 years old they have also killed his grandfather. Furthermore all their land positions and properties own by his father has been kept by the government they can prove that. They can not prove that the government his farther was sent to in prison, or his death certificate. His fathers names should also be registered in the united nations.

So just to clarify my questions:

1) If he seeks asylum will he be able to get any finacial support.?
2) can he change his tourist visa into a student visa without returning back to Iran?
3) How long will this process take, and can you please tell us how all this might affect his life in general.
