HSMP to Tier 1 - Self-Employed Process

Hello folks,

I got my HSMP in November 2007 and came to UK from December 2007. my HSMP expires in Nov 2009 obviously. So now I am due to apply in Tier 1 Process for 3 years.

Currently, I am working through my private company as a contractor for an IT company in Leeds.

I have some questions and would appreciate some help from the forum.

- Is there a defined documentation set on any site for self-employed people applying for Tier 1?

- Is there anyone who has done this before? If Yes, may I have your email address to contact you?

Hoping to get some responses for ya guys..

That would be correct mate. What more details are required for me to post? Sorry for being a novice. Is there anything I am missing?

Also, Would anybody know the lead time that is required for renewal before HSMP Visa expires?

For instance, my Visa expires in Nov 2009. May I eligible to apply now or I can only apply within -40 days from expiry?

Ok.
You would need payslips+bankstatement to prove your earnings.

You can apply for extension now as well. People has got early extension even 6 months before.

In the event that I am self employed Pay-slips I am able to get which basically means I am paying myself.

For bank-statements, I would have 2 accounts.. Personal and business.. which bank statements should be submitted?

Also, what Tax forms should be submitted. I am sure these would be required as well. In case self employed I am sure I would have to give two Tax forms.. one as a emplyer and another as an employee.. and thats exactly what I want to find out. What are these tax forms called and how do I get them.

I would suggest you to go thruogh the guidance 2-3times.. at the below link

hi sandeep,

as sugstd by tvn_ramesh.. you are better off reading guidance documents first.. as some of your questions are very basic OR have already been addressed in this forum (i.e. early application.. bank accounts etc...)

if you've been as a contractor and working thru a ltd company.. i assume u get most of your income as dividents.. read the page above, it also tells about how you can provide divident vouchers etc...

Cost of HSMP/Tier 1

Hello experts :)

I have read all links that were provided but am still confused about the cost to be paid:

Somewhere it reads:

"Reduced fee where aplicant has a valid HSMP approval letter: applicable transitional apprangements"

Does this mean the HSMP Approval Letter i got in Dec 07 or they mean the new one here?

Am a bit confused. Can someone provide more clarity?

As recommended you you fellows I have read through all the documentation on the all the sites. Given that, I have the following questions and would appreicate your help in resolving them out. I knw they are a lot of questions and may be I might have managed to get soe of you really confused as well. :) But then, I have been a victim before of incomplete/inaccurate documentation. :(

L7. The applicant should complete the following table giving details of previous earnings being claimed. If earnings originated from more than one source, each source should be entered separately.

Question: I should be stating my private company's earning here, right?

L8. The applicant should input his/her earnings into the Tier 1 (General) points based calculator and provide his/her total earnings claimed in pounds sterling.


Question: What value am I to fill? Net or Gross Earnings? Also, The amount that my company has earned or the amount that I have earned in Payslips and Dividends?

L10.

If I am working as a my own private limited company how do I show the following evidence:


a) Payslips

Question: This of course would be the minimum wage that I would be paying myself from my Limited Company. An amount close to £500 each month for 12 month period. While evaluating my application are they going to consider this as my
full earning for the year? If so I would not quality on earning criteria obviously.


b) Personal Bank statements showing the payments made to the applicant

Question: This obviously relates to the payments made into my personal bank account from my Business bank account.
The best I can do is highlight them and reconcile to the above, right?

c) Official tax document generated by the tax authority or the applicant’s employer, showing earnings upon which tax has been paid / is to be paid in a tax year.

Question: Is P60 the self assessment form that I do for myself working as an employee for my own company? If not,
What exactly is the purpose of P60 and is it applicable as an employee or an employer?

d) Dividend Vouchers

Question: I have got these, which mention that I as my company's sole stakeholder get the dividends. Should these be reconciled with my personal bank statements to show total earning as employee? Which means my total earning for the year is the Payslip amount and the Dividends?

e) Invoice explanations/payment summaries from the applicant’s managing agent/accountant

Question: Are these the invoices that I have issued to charge the customer which I should reconcile with my business bank account?

f) Company/business accounts which clearly show the net profit of the company

Question: Business account spreadsheet which shows net profit earned for the 12 months in question?

g) Letter from the applicant’s managing agent/accountant confirming that he/she received the exact amount that he/she is claiming, or the net profit to which he/she is entitled


Question: This is a letter from the accountant detailing net profits earned for the 12 months in question.

You have to first decide how you are going to claim points. As self-employed(who is keeping all the money in the business account) or as employee of your own company(director may be taking min. salary and dividends).
In later case, forget about the company account,invoices, business accounts etc. You will need to prove your personal earnings via salary (payslips) and dividends(dividend vouchers+letter from accountant) along with bank statement.

Also you will always consider GROSS(before tax) salary for calculating points.

Tier 1 - Help please

Finally I have acheived to get an appoitment for the 12th Oct 09 @ Sheffield after several attempts.

Key learning - Call at 8:55 to book an appointment.

I am thinking of applying as Self-Employed. All I need is guidance on which documents should I present for earnings section with self-employed. Would you be able to confirm if I am correct in listing these:

a) Invoices - Send to customer for which I would be paid

b) Divdends - Paid to myself as I am a sole stakeholder

c) Official Tax Document - This for self-employed should be the Corporation Tax Document. I started with my company Sept 08 which means I file Corporation Tax in Oct 09. I am sure I will not get this document as a proof for my appoitment. Would a document from my Accountant mentioning the Corporation Tax do?

d) Business Bank Statements

e) Company/business accounts which clearly show the net profit of the company - My Company Accounts Spreadsheet should do for this.

f) Letter from the applicant’s managing agent/accountant confirming that he/she received the exact amount that he/she is claiming, or the net profit to which he/she is entitled - Leeter fron accountant as it is mentioned.

Is there anyone who has applied as a self-employed before? Can you please help?

Hey Sandy,

Pls let me know what your outcome is on the 12th. I wish you all the best. My HSMP also expired in Nov but I had to post it last week when I couldnt get a date. I'm also an IT contractor with ltd company. I just hope I didnt make a mistake...:)

I forgot my payslips (£500/month), is it necessary since its really small? I'm thinking of sending it to them nxt week.
