Spouse Visa Issues

Hi,

I am an Indian citizen in UK since Jan 2007. I am working as IT Professional in London and I currently hold IGS(International Graduate Scheme) visa which will be expiring in August 2010.

My fiancée is British. We are getting Married (Religious) in Nov 2009 in India.

We would like to have our civil wedding in India as well but we can do it here if needed.

Could you please advice me about the procedure to apply for Spouse Visa? Do I have to apply in India? Can I come back to UK on my existing visa and apply here for Spouse Visa? As I have noticed that to apply for spouse visa in India will probably take a long(3 Months) and we can’t afford such a long stay.

Assuming that you are both aged 21 or over.

After a valid marriage, you may apply for a spouse visa or may switch to FLR(M), provided you satisfy 285.

Yes we both are over 21. We prefer to get married(Religious and Civil) in India, Come back to UK on my Existing visa(Tier 1 Post graduate Visa) which will be expiring in August 2010 and swith it to spouse visa.

Please advice me If We will not be able to do so.
