British Overseas Terriories citizen by descent prior to 1983

Hi There,

My question is simple - Am I eligible for BOTC by decent?

My mom and grandparents were born on the Island of St Helena. My mom has a full British passport.

I know that I’m unable to apply for British Citizenship because one of the requirements is that my mom had to be born in the United Kingdom (which does not include the territories)

[i]i) your mother was, at the time of your birth, a citizen of the United Kingdom and Colonies by birth, legal adoption, naturalisation or registration (except
registration on the basis of a marriage on or after 28 October 1971 to a citizen of the United Kingdom and Colonies) in the United Kingdom, Channel Islands orIsle of Man; [/i]


I’ve been trying to find the answers online but have not had any luck thus far. My frustration is that just because I was not born on the Island or UK I’m not entitled to even become a citizen of St Helena (BOTC). Does anyone have any information that could help me on my quest ï

Hi Jag,

I was born on the 1st December 1978 in South Africa.

- born between 8 Feb 1961 and 31 December 1982;
- had women been able to pass on CUKC in the same way as men, you would have been a CUKC.

You meet these two, however the third requirement:

- had you been a CUKC on 31 December 1982, you would have had Right of Abode in Britain.

As your mother and grandparents were from St Helena, you would not have had ROA. Were any of your grandparents on the paternal side from the United Kingdom?

The amendments to the British Nationality Act on British mothers only cover British citizenship, not BOTC.

Thanks for your reply. It's sad news :( my maternal greatgrand parents lived in St Helena too, I believe my maternal GGMother was Irish. My paternal grandparents were born in SA.

It's a pity that the The amendments to the British Nationality Act on British mothers did not take BOTC into consideration.
