Retention of Rights for family members other than spouse

Hi guys,

I am unclear as to what the rules are in regards to retention of rights of resident for other Article 2(2) family members besides spouses.

I am making long term arrangements to finish my studies in Ireland at Trinity college. I have secured a place for next academic year, but unsure if my EEA family member's departure from the state might affect my ability to continue my course, or how long she would have to be here for me to qualify.

Her employers acts quite erratic some times, one minute they are saying she would be placed year for a year or two, the other they are taking about posting her to Australia or America. I am frankly speaking fed up of moving from one country to another.

I applied to sit my life in the UK test in N. Ireland after i return from my holiday, but unsure whether i have any long term ambition of settling in the UK, which means i will be unprepared to apply for the passport, and swearing the oath of allegiance.

I made enquiries from the DOJ, but they said Article 13 paragraph 3 does not apply to my case.

Are they right guys? Would the circumstance change when i turn 21, when i would still be at University.

Any wise ideas from our gurus will be welcomed.
