Portugeuse citizenship for Goans?

Post by CliffP » Tue Aug 18, 2009 2:31 pm

My late father in law was born in Goa, which at that time was a colony of Portugal. He was a Portuguese citizen.

My question is are his children entitled to Portuguese citizenship?

Wikipedia tells me that children of Portuguese-born Portuguese citizens are allowed citizenship, but I am not sure if this applies to children of non-Portuguese-born Portuguese citizens.

My wife’s family are still in possession of their fathers Goan birth certificate but not his Portuguese passport.

Please advise,
Thanks

I've no advice for you, I'm sorry. However, I've noticed that the Wikipedia article also states:

Hopefully this might help. The Portuguese seems quite economical with provision of information.

Portuguese passport does not confer citizenship. It is simply a travel documents. The birth certificate is the most important thing.

Your wife will need to register her parents as Portuguese in Lisbon or the nearest Portuguese consulate overseas. Even at their death, they can still be registered.

Once she has done that, she can go on to apply for her Portuguese Citizenship, by virtue of been born to a Portuguese.

Please have a look at this Information, which will answer your question.

Does any one know the timescale of both registering my late father-in-law as a Portuguese citizen and then registering his children?

His children are in a few different countries, do they have to apply individually and in person? How long do they have to surrender their documents for? I have heard that applications from India can take years.
If I could take all their documents could I apply for them all in one embassy?

Also my father-in-law left Goa as a young man and so the only Goan document he had is the birth certificate.
His marraige, death and children's birth certificates are not Goan.
Does this count against us?
At no point did he not think of himself as Portuguese, and never renounced his Portuguese nationality.

It does if it describes you as "Portuguese". Although Portugal does issue passports to foreginers they are clearly marked.

No it doesn't. It is a reality that existed eg, Place of birth, Naturalisation Certificate obtained by virtue of having been naturalised, or registration that confer citizenship, which in turn confer Portuguese passport.

A passport is simply a travel document, which very rightly contains information of your nationality.

You become a citizen before you acquire a passport and not after.

Those reality precedes the acquisition of a passport.

There is no need for him to be registered again, if he had acquired Portuguese citizenship before he died and never renounced it.

You just need to obtain his records from the registry office.

Is this the registry office in Lisbon?
I think the Portuguese abandoned their records in Goa when India invaded/liberated it.
If he was registered as Portuguese in Goa before Indian independence does it follow that the info would have got back to Lisbon?
