Query abt wife's Naturalisation

Post by mr_pankaj » Sat Oct 15, 2005 12:19 pm

Hi Friends,

My wife got ILR along with me in March 2005 (I got it on the basis of 4 year WP). However, she arrived in UK in February 2005 and will be out of country for approximately 80 days until "my" date of Nuralisation i.e. roughly April 2006.

question 1 : can she "also" apply naturalisation along with me knowing that she would have lived in UK only for one year and that too 80 days outside UK.
Or would she have to be on ILR visa for another 4 years before she becomes elligible ?

question 2 : once she aquires the British citizenship, does she have any limit to be outside UK in any one year ?

thanks :P

Pan

Using your numbering :-
  1. There are actually two questions in your no. 1 ... the answers are No and No! Firstly if she has been here only for just over a year she cannot apply at the same time as you. But does she need to wait another four years? No, because by then she will be married to a British Citizen ... you! Accordingly she can apply three years after she first arrived in the UK.
  2. No, no limit at all. She will be applying as a spouse of a British Citizen. Accordingly she does not need to certify any intention to make the UK her home.
As regards an application by a spouse of a British Citizen, the person must not have been outside the UK for more than 270 days in the 3 years prior to the application being submitted, nor more than 90 days in the one year prior to submission of the form. There is a little bit of leeway on those numbers of 270 and 90, but not a lot.
