eea family member visa after divorce

eea family member visa after divorce

Hello.
I have a question about the visa.

I came to UK in 2005 12aug and i met my husband, we lived together since 2005.i was on a student visa. we got married in 2007 june and now i have a stamp attached in my passport, this is a family memeber visa valid until 2012 aug (so is for 5 years) my husband is from Latvia.

we are separated now, because we had accident (domestic violence)and i can not stay with this man.it happened in may this year.

we both want to divorce. we don*t have children.
but i don*t know what will be with the visa after..
i don*t know if i want to stay here because i wanted to start university or college.and everything is very stressful.
i am not getting any benefits and i work full time.

guys, i need a little advice in here..

got married with an EEA on the 06-0e9-2006 the date on the divorce petition that was sent is the 24-08-2009 which makes it 2 year 11 months and 18 days.. so 3 years less 12 days!!!!! how would that affect my application for the residence retention after divorcing an EEA national??????????????????

OP should also see Topic 5.8 and 5.9 on page 24-26 of this link , which gives the list of exhaustive documentations you need to provide to support your case.

hi
the HO will considere that you are no longer a familly member only after the divorce has been granted by that time you would have filled the 3 years required.(if you want to use the divorce route)
what you need to do now is to do your research regarding the evidence to support your application.

i do think there is provision with are victim of a genuine domestic violence.
