New citizenship act: could John please respond

Post by nitin023 » Thu Aug 13, 2009 8:23 pm

Hi,

I am an indian national who has recently got ILR in UK (May 09). I have two querries about naturaisation and would appreciate your response:

1. If during the final year (whilst in ILR), before applying for naturalisation if I live in UK for more than 90 days due to some family reasons how badly it would affect my chances of getting citizenship ?

2. Although probably it would be diificult for you to answer but if I could ask, that what is the likelihood of changes in naturalisation laws later this year due to introduction of new citizenship act

Regulations for BC won't change this year.
I assume you mean 90 days outside of the UK...not in the UK?

Assuming you mean OUTSIDE the UK for more than 90days then

1/ I guess it depends on how many days more than 90. the more days away the greater the chances of rejection

Check Section 5

yes , my apologies, I meant more than 90 days outside UK

When we say that regulations would not change this year, does it mean that new bill would be introduced this year but if passed the new rules would come in place after some time.

There is a more indepth discussion about the new bill and its implementation see http://www.immigrationboards.com/viewtopic.php?t=32413
i would say you should not be affected if you apply before July 2011

nitin023, so more than 90 days outside the UK in the last year, up to the date that UKBA receive the Naturalisation application ... but please give a clue! Are you talking of 91 days? 125 days? 180 days?

Seriously, roughly how many days are we talking about?

The answer is already given, in the link provided by f2k .... specifically look at 5.1.2 of that document.

Are you able to get the days absences down to 100? To get within the terms of 5.1.1?

many thanks, yes it probably would be possible for me to not to stay out of UK for >100 days. I am also able to show that my family lives here (my wife is a doctor working with NHS for few years, has ILR, my daughter hopefully would get British citizenship by then). I also have a house and paying the mortgage for 5 years. would that be sufficient to show strong ties with UK if absences are more than 100 days? thanks
