ILR for father

Post by mefe » Tue Jan 15, 2008 11:00 pm

I am british by birth and hold a well paid job. I have applied for ILR for my 73 years old dad who came to the UK on a visitors visa. Application was made in November '07; returned in December as I did not include information that I have been in the country since the last 3 years. The 'pack' was sent back with the requested information, but surprisely I received a letter in the first week of January '08 to fill in and submit information already sent with initial application, e.g. sponsor's name, dob, nationality, evidence of relationship with my dad, payslips, mortgage papers, etc.

My concern is - do they have any grounds for refusing him? My dad was here in the 50s to early 70s before he relocated to Africa. I have 6 other brothers and sisters who are based in the US. They want him to move to the US but this is a bit tricky at the moment, as nor of them are US citizens thus we reached the decision that it is better for him to remain in the UK until they acquire their US citizenship. However, I note the question of wholly financially dependent on the sponsor - certainly my dad is financially dependent on all his children - is this a credible ground for refusal? I believe if so, it can be legally challenged - what do you all think?

I read that it takes 4 weeks to conclude 70% of their decision and 14 weeks to conclude 90%. Is this delay unreasonably long?

AIT - Appeal won

Post by mefe » Mon Apr 21, 2008 8:32 pm

Further to my last post, the appeal was won over 5 weeks. Haven't heard from the Home Office for them to endorse the passport with the ILR stamp. Do I call them or just wait?

Maybe you should write to them for a follow up. You can also contact your MP?

Hi Sakura, thanks for your response. I did actually wrote to them last week, which they received as I sent it with recorded delivery. If I don't hear from them, I'd have to contact my MP and see how it plays out. If all fails I believe I will have no option than to take it back to the Court for resolution. The surprising thing is that it did not take them a week to debit my bank.
