Am I eligible for ILR?

All,

I am on a workpermit from Sep2004 to Feb 2008. I have shifted to HSMP from Feb end 08. I left to India in April 08 and returned to UK in Sept 08 and got into the job from Jan09.
I am on a probationary work assignment in India between Apr to Sept 08. But, because of the recession, I could not moved into permanent role until Jan09. Could you pls. let me know if there is any issue related to ILR?

I heard that if you are on a work assignment for a UK company but away from UK and kept your home in UK, there will not be issue if the period is long. I was on a probationary assignment in which I have been given allowances for which I have documents. But, I would like to know whether break in employment in HSMP be considered or not?

Only official trips outside UK are considered.

If your employer can provide you a letter that you are actually employed in Uk all time and you were sent to India for that 6 months officially then you can apply for ILR.

If your Employer cannot provide that sort of letter then your clock is reset

Yes. My employer has told that he will provide the letter for the work assignment that was done in India for the period between April to September 08. But what I would like to know is that since it is on probationary, I was paid the amount in India as allowance and because of recession, I was not on the role between Oct to Dec. So, will that gap cause any issue?

I dont think being employed probationary/ permenant / Contract matters. all they need is You should be working Full time (not part time) and your income should be enough to support you and your dependants without getting any loan from others

Also small Gaps in employment doesnt matter when you are in HSMP as long as you can support yourself with your past earnings

Gaps in employement matters when you are in work permit (because 28 days of gap will invalidate work permit)

But you must be employed when you are applying for ILR thats it

can u tell me how clock reset works in detail ?? i am confused on clock reset ????? please can u explain ?
