PSW refused due to no points on maintainance fund

my wife is a main applicant and i m the dependent on her.. she had applied for transistional PSW but our visa was refused.. coz' we didn't hav sufficient fund for at least fifteen days.. actually we didn't know about this rules that we must have personal savings of £1,330 (including dependent).. and when we knew this rules it was already late.. coz we were on holiday for a month on jan-feb.. our visa was until 17th june 09... we made a statement from 13th march to 13th june 09 but our enough balance was from 27th march 09. and on 10th july 09 we had our passport back from HO without visa with refusal letter.. now we r thinking to appeal in terms of our income source.. coz we earn more than £1,330 every month.. or do anyone has any idea about this case.. plz reply ASAP... we will really appreciate any kind of comment and suggestion

Vinny has already explained via this link. It would be difficult to win an appeal, if you can not show that you had the required amount for the time in question.

BUT having said that, Please make sure that you do appeal as this is your last resort, It will all depend on the Judge. Get some legal help as well if you can.

Do you have another account somewhere with some saved monies in it between 13th march and 27th march?

yes we do have overseas account back home

All you need to do in your case, is to show you had more than £1,333 between 13 Mar and 27 Mar. If you have got an overseas bank account which covers this period, you can show it the judge and your appeal would be allowed.

However, you cannot appeal arguing you earn enough to support yourself and your dependant. The only evidence accepted for the purposes of PSW is that specified in appendix C of the immigration rules of points based system. There is not mention about wage slips or certain level of income.

It means if you cannot produce the evidence which shows you had enough funds between 13 and 27 Mar, then, unfortunatelly, your appeal could be dismissed. But for now, keep positive. Try to find the required evidence, appeal and then see what happens.

1. If u appeal is allowed then u need to wait for 5 working days if HO wants to appeal gainst this decision.

2. If u do not hear within 5 days then it means that u have won u appeal and HO has accepted the decision.

3. The normal time is between 1 to 3 months and that is normal time plus can be longer than that.

4 There are people on this forum waiting for more than six months and still have not received the letter to send the passports for the visa so please join the queue.

my wife and i waited 4 months before HO requested for our passport after our succesful appeal. this was even after involving our MP to contact the HO.
We were told tht there is just no way of fast tracking this issue.

so bottom line.... u wait buddy!
