Early Education Funding (EEF) for 3-5 Year olds

I am on HSMP my child is 3 years old, am i entitled to the following

Q1. Early education funding for 15 hrs a week at a nursery ?

Q2. My employer can give me childcare voucher from gross salary before tax is that allowed ?

Please answer as soon as posible as she starts nursery next week.

Yes every 3-4 years of Age are Entitled to 12.5hrs stated funded childcare in the UK. However you are not allowed Child Tax Credit to supplement you with additional cost of childcare as this will be considered to be recourse to Public fund. However if your spouse or partner has a settled status, he can claim for assistance in that respect.

Also your employer is free to give you Childcare vouchers and this will not count as public funds. However please note that you might get taxed on the allowance you get if it exceed £55 a week.

In a nutshell, all what you are doing is not overboard and will not affect your HSMP application. However please note that you will need to pay for childcare that exceed 12.5 Hrs a week, which you can use your vouchers to cover.

I have got confirmation for various sources by now and you are 100% right there thanks for your reply

There is a good reason for that. There is absolutely nothing education-related in the definition of Public Funds, as in para 6 of the Immigration Rules.

It also explains why it is totally OK for children to attend state schools, irrespective of the immigration status of them and their parents.
