Previous earnings - Tier 1 (General)

Previous earnings - Tier 1 (General)

Hi Friends,

Thank you for reading...I have a small query regarding previous earnings requirement in Tier 1 (General) and would like to get some advices.

1. Can I claim my previous earnings from my part-time employment under student visa (within last 10 months and I have payslips for this part-time employment)?

2. I have one month without earnings during last 10 months due to waiting time for applying to switch my studnet visa into Tier 2 (General), in order to work for a new employer.

Now I want to switch into Tier 1 (General). Am I egilible to claim both earnings: previous part-time work (under student visa) and full-time work (under Tier 2)? Both my previous earnings are within last 10 months.

Yes you can claim earnings of your student visa for Tier-1 application. But make sure:
1. You have corroborative evidence for the same i.e. payslips and bank statements, and
2. you have worked for the time allowed by your college/course. For e.g. if you are allowed to work only 20 hours a week, you should not exceed that time on student visa or atleast not claim it.

Thanks very much Chetanojha! I worked only 20 hours per week in term-time and 40 hours per week outside of term-time.

I have one-month without earnings during last 10 months (i.e. earnings interruption). I am wondering whether I will qualify for this earning claim. I read the information in UKBA website but still confusing.

The period of earnings we will assess:

Earnings must be made up of 12 consecutive months and must fall within the 15 months before your application.

You can claim points for a 12-month period outside of the 15-month period only in very limited circumstances. These are if you have been away from the workplace for a time during the last 12 months because of:

- full-time study; or
- a period of maternity or adoption-related absence.

You do not have to be in continuous employment during the 12-month period being assessed, so:

- you can claim for a period of earnings less than 12 months; and
- earnings do not have to be from a single employer and can be from full-time, part-time, temporary or short-term work.


If you claim for a period that is more than the 12 months, we will assess the most recent period of 12 months for which you have sent evidence

Thanks Push, I understood and no trouble at all :D.

I also learned from UKBA website that HO will assess the gross salary before tax. Does it also mean gross salary before National Insurance/Pension deductions? Thanks!

Many thanks for every body! I have a last query concerning Tier 1 and Tier 2.

For my case, I actually still continue to work for my current employer (Tier 2) after switching into Tier 1 (General). So do you think I shoud apply for this switch from my current Tier 2 to Tier 1? I'm really not sure how's better the Tier 1?

Not sure what your query is. First you say that you are continuing to work with your employer after switching into Tier 1 then you say should you switch into Tier-1?

Sorry for unclear query. I am currently working for my employer who has been a sponsor for my Tier 2 (General) untill the end of 2011.

I don't know should I apply to switch into Tier 1 because I'm not sure which one is better: Tier 1 or Tier 2?

Tier-1 is always better from candidate's perspective. You can look for job independent to your employer. Go for contracting etc etc.
Tier-1 without a doubt best option.
