refused visit visa

Post by SMOOTH OPERATOR » Fri Sep 11, 2009 12:49 pm

hi Guys

my brother applied for a visit visa in lagos, Nigeria. I am the sponsor of his visit and submitted my copies of passport data page, ILR page, bank statements both mine and the mrs to proove he will no be a burden on us and that he can be accomodated, both of our payslip (8 months), Title Deeds of the property and sponsor's letter

2 of the reson for refusal were that:

1) proof was not provided that we were siblings!!!!!(i thought they sometimes carry out dna tests? why did they not do this?)

2) the payslips and bank statement i submitted were photocopies and not original!!! ( i thought thay had a way of checking if is was fake or not) where does it say the sponsor must produce original payslips and bank stmt instead of copies

in my letter to the embassy i stated that I will be glad to provide any more information from at anytime as my contact details has been made available

however we can appeal. wot do u think guys?

1) Do you have something like Birth Certificates showing your parent's names, linking you two together? If so, provide them.

2) They ALWAYS want originals as far as documents are concerned, especially bank statements! Otherwise, you need to explain in the 'Additional Notes' section why you have failed to provide originals! So you will need to provide the originals of these.

If the visa has been refused on these grounds only, I reckon it will be issued if you can address them.

Guidance - Sponsors (INF 3)
Last updated 16 July 2008

What evidence can I supply?
You should send any supporting documents to the person you are sponsoring so that they can include them with their visa application. Please do not send any documents direct to the visa application centre.

There are no hard-and-fast rules about what documents you should produce when sponsoring a visitor to the UK. You may want to produce evidence of your own immigration status in the UK, and there are some other things you can do, particularly if the visit is for a special reason.

If the visit is for a holiday and you are a relative or a friend, a letter of sponsorship explaining your relationship to the applicant and why the visit is taking place at this particular time may be helpful.
If the visit is for a special family occasion (for example, celebrating a wedding, a birth or an important anniversary), an invitation giving details of the event, when and where it is to take place, and a letter of sponsorship would be helpful. If the person you are sponsoring is not a close relative or is one of several people invited to the occasion, it would be helpful to know why the applicant was chosen to attend.
If you are offering to provide support and accommodation, or to pay for travel to the UK, you must provide evidence of your ability to do so.

The following would be helpful.

A letter of sponsorship giving details of your occupation and salary and how you will provide support and accommodation for the applicant. There is no need to have this letter certified (in other words, signed) before a solicitor or commissioner for oaths to confirm it is genuine.

Evidence of your ability to pay for the trip, such as copies of your last six months' bank or building society statements and salary slips. If you receive public funds, the Entry Clearance Officer will need to consider carefully how long you will be able to support other people on your limited means. You will not be able to get extra public funds to support the applicant.

What was, or were the reasons for refusal.

Firstly, I'm not a 'dude'!

Secondly, if they want your original bank statements, then perhaps you could submit them with a covering note, saying that you would like them returned to you after their perusal.

Please See THE ENTRY CLEARANCE GUIDANCE and Grounds for Refusal

Also see this:

ECOs should not seek documentary evidence of a claimed relationship unless there are strong grounds to doubt it (such as a disparity in age that makes the relationship biologically unlikely).
I don't think it should form the basis for refusal.

Certainly worth appealing.
