What if there is a break in sal in 12 consecutive months

Post by vasudanesh » Sun Sep 13, 2009 3:47 pm

Hi All,

Im applying for my extension this month (Sep'09) please advice on following scenario.

Since I'm applying on Sep'09, last 12 months start from Sep'08 and in this 12 month period I was unemployed for the month of July'09 wherein I have payslips from Sep'08 to Jun'09 and again from Aug'09 to till date. Kindly Advice on which out of following scenario I can use whiling applying for extension.

Scenario 1

Months Amount Employer

Sep-08 £ XXX Employed
Oct-08 £ XXX Employed
Nov-08 £ XXX Employed
Dec-08 £ XXX Employed
Jan-09 £ XXX Employed
Feb-09 £ XXX Employed
Mar-09 £ XXX Employed
Apr-09 £ XXX Employed
May-09 £ XXX Employed
Jun-09 £ XXX Employed
Jul-09 £0 Un Employed
Aug-09 £ XXX Employed

Scenario 2

In this I'm excluded Jul'09 and included Aug'08 meaning 12consucutive paid months in the past 15 months.

Months Amount Employer
Aug-08 £ XXX Employed
Sep-08 £ XXX Employed
Oct-08 £ XXX Employed
Nov-08 £ XXX Employed
Dec-08 £ XXX Employed
Jan-09 £ XXX Employed
Feb-09 £ XXX Employed
Mar-09 £ XXX Employed
Apr-09 £ XXX Employed
May-09 £ XXX Employed
Jun-09 £ XXX Employed
Aug-09 £ XXX Employed

Kindly advice which of above two scenario is right?[/u]

Scenario 1 is right.

The 12 month period has to be consecutive, i.e. no breaks allowed.

So you can show 01/08/2008 to 31/07/2009 or you can show 01/09/2008 to 31/08/2009. But it has to be that period.

Use whichever is to your advantage, but no breaks are allowed.

Simple rule: End date of earning period should not be more than 12 months after the start date (unless period is interspersed by full time education/maternity leave) . The whole period as selected above should be within 15 months of the application submission date.

If you comply with the above you should be fine even with breaks in employment.
