I am in UK on HSMP (approval letter issued on 20 Feb 2008) and submitted an application for my Wife's HSMP dependent visa in Lahore last week.
When my wife visited Lahore visa application centre, they did not accept VF2 form and made her complete and submit VF10 form instead which was for HSMP Tier 1 Transitional Dependent.
When she went to the counter visa officer checked her documents in detail. When he looked at my FLR (issued 17th March 08 to 14th March 10) he said that the application form (VF2) was incorrect. He consulted with his colleague who was sitting in another counter and she also said that it was wrong. My wife insisted that it was the correct and she had taken assistance from a law firm in UK. He then checked it from a third colleague who said the same. When my wife insisted to use the same form again he sent her to meet his manager who said the same. Its therefore not about negligence of one officer but all 4 who looked at the documents.
Her application was dealt under Dependent of Tier 1 general applicant with HSMP approval letter (transitional arrangement). I believe that transition arrangements came into effect from 1st March 2008. My HSMP application was made on 23 Jan 2008 and approved on 20 Feb 08. Rather than looking at HSMP approval letter (to confirm whether i fall under these arrangements), they looked at FLR (which is dated 17 Mar 2008) and assumed that I was on HSMP transition arrangements.
Despite her best efforts, they refused to accept my wife's application with VF2 form.
During submission of the application, documents are checked by officers and if anything is missing or incorrect, they do not accept the application. In this case, since application form used is inconsistent with my current visa, it is clearly an error by application center.
My questions here is, that since visa form used is inconsistent with my visa, what would happen now? If they reject visa, on what basis will they reject it, since its their mistake. Is there a possibility for them realising their mistake and granting visa or is it just me being over optimistic.
Is there anything I can do now to rectify the situation? Should i send/fax/email documents or withdraw application altogether.
