UK Permanent Residence based on 5 years Non EU Family permit

Post by yurkin » Tue Sep 29, 2009 12:27 pm

Hi,
This topic has been discused before, but my search didn't return anything.
Could someone please clarify on when to apply for Permanent Residence and Naturalisation?
Here is my timeline
I am Non EU citizen.
10/2003 Entered UK on student visa
01/12/2004 Married Spanish national in London on student visa.
20/04/2005 Aquired 5 years EU Family Resident Permit.
02/2007 My spouse was granted British Citisenship and holds 2 citizenships now.
I didn't switch to UK Family Route then :D and stayed on the EU route.
Now, 5 years since my wedding are running out on 01/12/2009, I guess I can apply for Permanent Residence.
I read on this forum that the Family Permit date in my passport is just a formalisation and 5 years count down from the date on Marriage Certificate. It's according EU directive.
Is that correct?
Given thiat Permanent Residence is automatic and I dont have to apply for it (according to Home Office website) and that my spouse is now british I wonder if I will meet the requirements to apply for Citizenship after my 5 years that is on 01/12/2009?
I am sorry if my story is messy.
Any help to clear my doubts is much appreciated.

Thank you :D

You will acquire PR on 01/12/2009. You can apply for a Permanent Residence Card on form EEA4 if you wish.

My understanding is that you will be eligible to apply for naturalisation as the spouse of a British Citizen immediately after 01/12/2009.
I am no longer posting publicly on this website - PM me if needed.

benifa thank you very much for quick reply.

I just wonder if I applied on 02/12/2009 for naturalisation how could I prove to Home Office that I am eligibible to apply for Citizenship as I have neither Permanent Resident Card in hands nor Permanent Residence sticker in my passport?
All my documents are in order, but will it be enough to convince HO in my eligibility?

The sticker is just a confirmation. You will have to proof your status anyway with your documents and the proof of your spouse's citizenship.
