Tier 1 application - dependants' travel situation

Post by nirmal_kishore » Sat Oct 10, 2009 2:09 am

Hello Folks
I was at the verge of applying for a Tier 1 application(switching from WP), but I stumbled upon an a rather uncomfortable situation and could not think of a better place to get some advice.

My wife and son are having to travel in a week's time and I seem to be left with 3 options:
Option 1. Somehow find a PEO appointment (this ain't easy) and get the whole thing done in a day so that they get the dependant stamps done as well.
Option 2. Wait till they return - this isn't a very bad idea but I am so prepared at the moment for the whole thing (particularly with the maintenance funds stuff) so I better get this cleared quick. Also, they might be gone for atleast 2 months and I don't quite want to stay on my Work Permit for that long.
Option 3. Let them travel as they plan to, send my application alone, and then get theirs applied separately. I know this is an expensive thing on the whole considering their applications will on their own cost about £800 each. Leaving the cost aside, this is where I think I need particular suggestions. Firstly is it possible for them to return back to the UK on their 'Dependant of WP holder' visas after 2-3 months during which time I would have switched to a different visa category i.e. Tier 1? If the answer is a yes, then it isn't too bad. However if they are not going to be allowed to enter the country back in after 3 months, my option then would be to get them to apply in India as dependants of Tier 1 visa holder. In that case do I have to show maintenance funds etc? and how much would that be?

Don't know if this a common situation for candidates out there but any advice will be very much appreciated.

Thanks
Nirmal

Also, they might be gone for atleast 2 months and I don't quite want to stay on my Work Permit for that long. this is also possible but i can tell you that this whole 2 months period and the period when you'll apply for their dependent visa will test your nervous level to the highest extent, plus for all that period you still need to maintain maintenance funds. personally i wont prefer this way

ok if you cant get the same day appointment by anymeans then prefer this way send your application, let them travel, i am almost 100%sure that they can come back as WP dependent visa while you have switched to Tier1 its no problem, and yes untill every one gets their visa done you need to maintain funds in your account.

Don't know if this a common situation for candidates out there but any advice will be very much appreciated.

so in priority order, option 1, option 3 , option 2
Be very cautios when chosing solicitors, someone on this forum informed me that an xyz solicitor arranged a sameday appointment for him but after few days informed him that homeoffice has cancelled the appointment.

and this is my personal experience that i was willing to pay as much as £1500 for the same day appointment to a well known solicitor but they couldnt arrange an appointment for me.

so if you keep this in mind then priority order changes to 3, 1, 2.

good luck
