Am I able to become a Belgian citizen?

Post by ccb939 » Thu Oct 15, 2009 6:38 am

Hi, I am from Hong Kong and I hold a British National (Overseas) Passport, as well as a Hong Kong SAR Passport. I would like to live in Belgium since I visited there 5 years ago.

My friend travelled to Holland and Belgium last month and he told me that, the immigration officer did not stamp on his British National (Overseas) Passport. Does it imply British National (Overseas) Passport holder can live and work in Belgium due to Treaty of Lisbon?

If not, is there any other means that qualifly me to live in Belgium? Thank for answering...!!

Yes, I know that BNO has no EEA rights at this moment. So is there any legal methods for me to live in Belgium?

Get a work visa.

And why would the Lisbon Treaty give a BNO passport holder the right to live and work in Europe?

By the normal routes for immigration to Belgium as a non-EU citizen.

I do not have much knowledge in EU Law, but if you read the treaty carefully, you will find:

Article 355 (ex Article 299(2), first subparagraph, and Article 299(3) to (6) TEC) 5. Notwithstanding Article 52 of the Treaty on European Union and paragraphs 1 to 4 of this Article:

(a) the Treaties shall not apply to the Faeroe Islands; the Treaties shall not apply to the United Kingdom Sovereign Base Areas of Akrotiri and

(b) Dhekelia in Cyprus except to the extent necessary to ensure the implementation of the arrangements set out in the Protocol on the Sovereign Base Areas of the United Kingdom of Great Britain and Northern Ireland in Cyprus annexed to the Act concerning the conditions of accession of the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic to the European Union and in accordance with the terms of that Protocol; the Treaties shall apply to the Channel Islands and the Isle of Man only to the extent

(c) necessary to ensure the implementation of the arrangements for those islands set out in the Treaty concerning the accession of new Member States to the European Economic Community and to the European Atomic Energy Community signed on 22 January 1972. Consolidated treaties (the result of the amendments) page 259.

「In 1982, in view of the entry into force of the British Nationality Act 1981, the United Kingdom Government lodged with the Italian Government, as depositary of the Treaties, the 1982 Declaration, which replaced the 1972 Declaration with effect from 1 January 1983. The 1982 Declaration provides: 『As to the United Kingdom of Great Britain and Northern Ireland, the terms nationals, nationals of Member States or nationals of Member States and overseas countries and territories, wherever used in the Treaty establishing the European Economic Community, the Treaty establishing the European Atomic Energy Community or the Treaty establishing the European Coal and Steel Community or in any of the Community acts deriving from those Treaties, are to be understood to refer to: (a) British citizens; (b) Persons who are British subjects by virtue of Part IV of the British Nationality Act 1981 and who have the right of abode in the United Kingdom and are therefore exempt from United Kingdom immigration control; (c) British Dependent Territories citizens who acquire their citizenship from a connection with Gibraltar.
