New born and HSMP and ILR

Hi,

I am hoping someone can help me with my query as even with an expensive immigration lawyer I don's seem to be getting far.

In March 2010 I'll be applying for the ILR having been on a combination of work permit and HSMP for 5 years. In Dec 08 we had a child and the three of us (wife son and myself) all have Australian passports.

My wife has the HSMP dependancy visa-we have not got a stamp into our son's passport. We have been in and out of the UK (short trips) about 3 times since son was born, it always was a problem coming back into the UK.

Question: Can anyone tell me with some sort of certainty if we need to get my son a dependancy HSMP or can I wait till March 2010 and apply for the ILR for the 3 of us?

Joseph, If you are planning more trips out from the country before you will get you ILR then it is better to apply for your son now as your dependent and if not then once you got your ILR, you can apply for his BC (Register him as british) under section 1(3).

Thank you for your reply. I would like to travel once around Christmas, is it worthwhile applying for my son as a dependent since I am applying for the ILR in March?
