Wanderer it has been ruled by the European Court of Justice, that what a member state chooses to do with their internal matter is completely up to them. People who move to another memberstate are governed under EU law, using a different yardstick from that which member state imposes on their nationals.
Therefore it is not because it is not provided for in their national legislation, it is purely because they want to violate and ignore the law.
Italy says that Same Sex marriage/ Same Sex relationship is a violation of Public order and hence public Pulicy, however, it does not stop them recognising it for EEA national in the Regulation they used to transpose Directive 2004/38EC.
Most of what they failed to transpose, are mandatory in nature, and i found it astounding that someone has not taken them to court to fight it.
Some great EU ruling like Diatta came from Germany. I am sure some would come to the EU courts of Justice in due course, or perhaps overdue course
