Hi,

Can any body help me as im a irish citizen married with Pakistani citizen living in Northern ireland. we have two childern togather both kids have irish passports.
We are married now over four years. My husband have only temp entry visa of Uk, his case is in home office from last four year but they are not replying as he firstly entered Uk with out visa.

Now im sick of waiting was thinking to apply for Irish Naturalisation for my husband coz im a irish.Just want to know can i apply for him?

Hi ishaimran.

Yes, your husband can apply for naturalisation as an Irish citizen, based on marriage to an Irish citizen and resident on the island of Ireland for at least three years. Note that processing of naturalisation application takes the Department of Justice about 3 years.

However, you may be unaware that, as an Irish citizen resident in the UK, your spouse has the right to reside with you, in accordance with EU Directive 2004/38/EC.

Frankly, you can give the UK Immigration Rules the finger.

Your husband's residence in the UK is lawful, so long as you are either employed, self-employed, engaged in a course of study or are financially self-sufficient.

In which case, he has the same rights in the UK as you do. For example, the right to be employed, to be self-employed or to be engaged in a course of study.

The UK's implementation of Directive 2004/38/EC is the The Immigration (European Economic Area) Regulations 2006.

Your husband should apply for a Residence Card of a family member of a Union citizen, using form EEA2. An application for a Residence Card must be processed within six months of submission.
