US Citizen Living in the UK Seeking Divorce from UK Citizen

Post by walkergw6 » Sat Oct 31, 2009 11:45 pm

It is with regret that I must inquire about my immigrations rights as I intend to divorce my UK national wife. We were married in the US fifteen years ago, so I had no difficulty obtaining a UK Indefinite Leave Visa in 2007. Since relocating to the UK, my relationship with my wife has deteriorated and I am considering divorce. I am seeking advice about my rights to remain in the UK after the divorce. Also, if someone knows a reputable divorce lawyer who is versed in immigration law, I would be grateful for the recommendation.

Regards,

ILR is Permanent Residency so you are fully entitled to remain in the UK in perpetuity.

You say you were issued with ILR due to the length of time you had been married. Was the initial visa ILE (KOL REQ)...ie, ILR once the KOL test had been passed? If so, have you passed this and been issued with ILR?
ILE is issued outside of the UK and ILR from within the UK.
