ILR ENQUIRY - applying for dependent

Hi,
I'm completing 4 years in Work Permit and i can apply for ILR this Dec 2005 or Jan 2006.

But few queries about including spouse in the same application. What is the eligibility criteria needs to be satisfied by her.

She got married to me on 2nd Sep 2004 and first entered UK on 17th Sep 2004. Is there any minimum period she needs to be in UK to be eligible to apply?

Your help is much appreciated.

Your wife's visa expires on the same date as yours? That should be the case, and confirm that she is in the UK as your dependent. Accordingly when you use the form SET(O) to apply for your ILR you should include your wife on that form ... and she should get ILR as well as you.

But just carrying this forward in time ... after you have had ILR for one year you can apply to be naturalised. However your wife will not be able to apply at that time because she personally will not have been in the UK for five years. But the plan should be that you will apply for naturalisation as British as soon as you have had ILR for a year, say in January 2007.

Then when you are British ... surprise, surprise ... your wife will be married to a British Citizen! Accordingly it will be the case for her that she will be able to apply for her naturalisation as soon as she has been in the UK for three years .... late September 2007.

Yep. She is a dependent and both of our Visa expires on Nov 2006.

About applying for my ILR (in my case, I've been 9 months out of UK due to business reasons), would it be better to apply thro' POST or go in person to any PEO office? Is my application straightforward?

From the SET(O) form, I'm able to see
"We can only offer this service for applications which are straightforward and do not require further
enquiries."

Hi

You need to take company letter stating that your visits / stay out of UK were on behalf of your company and there was no change in your employment status while you were abroad along with the other documents. All of my friends with absences from UK were able to get ILR on the same day.

Hi Jaz,
Has any of ur friends got ILR with long absences beyond 9 months?
Is there any format of the letter from the employer to substantiate the absence?

This format I have used for my 3.5 Months absence and got the ILR Sucessfully.

I don't know this enough for your case.

Dear Sir/Madam,

This is to confirm that MrXXXXX is an employee of YYYYY, UK. He is currently working for the company as a ZZZZZ in a permanent position.

Mr. XXXXX has been employed with us since DD/MM/YYYY.

During his employment with us, Mr. XXXXX was away from the UK for a period of X months and Y Days (From DD/MM/YYYY till DD/MM/YYYY). During this absence, Mr. Mr. XXXXX carried his work in our AAAA Branch office and his employment with the UK Office was continued during this period. Mr. XXXXX resumed his duty in our UK office from DD/MM/YYYY and after this he is not away for more than 4 Weeks from the UK in any one year.

His annual salary is £GBP.

YYYYY considers Mr. XXXXX to be responsible and trustworthy. I confirm that his employment with us is continuing in the foreseeable future.

i had a similar situation with regards to spusal visa. my wife was on a dependent visa for less than a year when we applied for ILR and we both got it. i have applied for naturalisation on the basis of 4 + 1 year, and she is going to apply next year on the basis of married to a british citizen 3 years.
