Uk Citizen married to an indian citizen - spouse application

Post by Rahularora » Mon Nov 16, 2009 2:17 pm

Hi Everyone,

I am a UK citizen and have done the civil/registry marriage in India in august 09. My wife and i intend to have the religious ceremony in jan 2010.

We applied for the spouse settlement visa at VFS Delhi on the 16/10/09. The tracking status currently says under process with the british high commission.

We have submitted (in my opinion) an exemplary application, with full supporting documents etc. Whilst reading through these boards, i came across one of the home office documents linked to by one of the moderators.

Assistance from other sources
A couple who are unable to produce sufficient evidence to meet the maintenance requirement, may provide an undertaking from members of their families that they will support the couple until they are able to support themselves from their own resources.
This is not acceptable as the Rules require the couple to be able to support
themselves and any dependants from their own resources. Nevertheless, such an arrangement may be accepted exceptionally if it is clear that it would only be in effect for a limited period and the couple have a realistic prospect of supporting themselves thereafter

This part has thrown me off slightly - i have submitted the proof of income (excess of £24K PA) plus sufficient bank statements etc, but as we have a family business, my parents wrote a joint letter that they will be handling all our living expenses... will this be in contravention to the BHC's rules? I am getting really nervous as to time frames etc, we are having the religious ceremony in delhi on the 3rd Jan, and leave for our honeymoon on the 9th, and hoping to enter the UK on the 17th Jan - all the tickets are already booked, our family is considered to have a very good standing in the community and have heavily invested in the UK in commercial and residential ventures - we have highlighted all these factors in the covering letters.

do you think it would be advisable to get pressure exerted from people within the K in prominant public positions - is there any way of tracking this application from within the uk (apart from the VFS website)?

look forward to hearing from you guys soon.

Thanks a lot!

Rahul

It would be too soon to enlist help from MP or 'people in high places'.
Although your parents are able to offer accomodation it would have been advisable to state in your application that you would be contributing at least a nominal amount for food and basic household expenses once your wife joins you.
Processing may take 12 weeks.
