partner is overstayer, me ILR, joint claim for TC made in september, 2009. hmrc, sent letter advising that claim cannot be processed as partner has no NI no. i put cover letter explaining why, and Jobcentre (advised by hmrc) have sent interview for NI no. for my partner, with whole list of documentation required, mainly pp, HO letters, marriage cert, utility bills, etc. explained that we cannot provide main docs, but TC says just attend appointment. i asked that so bcoz partner has no NI does that mean i won't get TC, answer partner should attend interview. what's likely to happen if he attends or doesn't. does it make any difference since he still cannot get NI no.?

You will get TC … it is just that TC needs to be assessed jointly. He needs to attend the NINO appointment and if he also has NHS card please ask him to take that with him.
