My wife is from EU she exercised her treaty right since 2004 and became Resident under EU law in 2008

my self I am not from EU, I became Resident of Family members of EU/EEA nationals this year

my son was born in 2006 not registered to any embassies of our country origin,

my question is

-would my son be able to travel abroad without going through citizenship & British passport? (can't offer to pay fees for now also we've been advised do that collectively when we'll be all entitled to do so)

contacted HO by phone, they said i need 'family member permit' BUT i have to apply for it in the country where i am travelling to! ( can't offer this too, as the location of British Embassy which is few hunders miles away and also can't tell how long this is going to take) not an option to consider for someone planing just for holidays!

please can someone confim this, or point me to where i can read more...!

Presumably your son can take his mother's European nationality? So get him registered as a citizen of that country, get him a passport, and he doesn't need any form of visa to travel throughout the EU.

He needs a travel document of some sort, and the obvious one to get is the European one.

I don't understand what your problem is (unless your son was born to you by another woman, but then your wife might have noticed something).

With regards to your comment about the British Embassy being several hundred miles away, you have misunderstood UKBA's advice, which would have been that if you wish to travel to, say, France, you would have to apply to the French Embassy in the UK for a visa/ family permit. To return to the UK, you should ensure that your Uk Residence Card is still valid
