In which country should we marry?

Post by frankie » Tue Dec 08, 2009 12:37 am

Hi,

Can someone point me to some information about marrying my US fiancee in the UK, but with a view to us settling in the US. My fiancee has dual nationality (Swiss and US), but is lives (always has done) in the US.

I assume that we can marry in the UK (I am a British national) without any real problems because of her Swiss national status, but what would this mean (if anything) for me moving to the US to live with her?

Thanks.

Yes, you're right you can marry in UK with out any problems or trouble. Her Swiss nationality will have no bearing on you moving over to the states. However, her being an American citizen is what will help of course. You would have to go through the long proceedure of either the CR-1 visa or K3.

Thanks for the reply.

I guess I was trying to find out if the process of me moving to the States is made any easier or more difficult by us marrying in the UK. Is the process of CR-1 any easier than K3?

Nope not any easier or harder if you marry in the uk. The CR-1 is not easier as far as the amount of time it takes. However, it's considered an immigrant visa which means as soon as you get to the us, you are allowed to work, you will get a social security number etc... On the K3, you will have to adjust status soon after (which means more money) and you will have to apply for a work permit before you can work. I would say the CR-1 is a much better option.

Hi Elena,

I'll look more into the CR-1 route.

Thanks.
