Hi i wonder if anyone can please help me..

i want to bring my husband to the UK. I am albanian myself but i got my BRITISH PASSPORT 10 years ago..

I APPLIED IN THE BRITISH EMBASSY IN TIRANA 2 YEARS AGO AND MY HUSBANDS VISA WAS REFUSED..

WE NOW HAVE A CHILD TOGETHER HE IS ONE YEARS OLD AND HE WAS BORN HERE GOT HIS BRITISH PASSPORT.

I WANT TO APPLY AGAIN FOR A FAMILY REUNION FOR MY HUSBAND TO JOIN US.. I AM IN EMPLOYMENT I ALSO HAVE ACCOMODATION BUT THE PROBLEM IS THAT I HAVE COUNCIL ACCOMADATION THAT I PAY THE RENT TO MYSELF IS THIS ALLOWED FOR A VISA APPLICATION????


CAN SOMEONE TELL ME WHAT DOCUMENTS I HAVE TO PRODUCE ... I HAVE ALREADY READ THE RULES BUT CAN SOMEONE PLEASE HELP ME ANYONE WHO HAS APPLIED AND THEIR VISA APPLICATION WAS SUCCESSFUL in the same situation TELL ME WHAT DOCUMENTS THEY TOOK IN THE EMBASSY/... I HAVE TALK TO LOADS OF LAWYERS NONE WERE ABLE TO HELP... THEY ALL TOLD ME THE SAME THINGS...

If your problem is not solved yet I suggest you and your family first go to any other EU member state (you have the choice out of 26) before you come to the UK. The latter is possible after a common stay of about six months as now also for a stay in the UK EU rules apply.

I can only talk from my own experience. I am British and my husband is Albanian. He applied at the British Embassy in Tirana in December 2006 for a 2 year spouse visa and was successful (he also got in March 2009 Indefinite Leave to Remain and is hoping to apply for British citizenship in March 2010).

Anyway, the British Embassy in Tirana took nearly 4 months to make their decision but they granted him the visa. The documents we supplied were a Tenancy Agreement in both our names, our Marriage Certificate, a BT telephone bill in his name and a Sky TV statement in my name, bank statements and payslips (6 months worth) for me to show that I was working in the UK and could support myself and my husband if needs be, I can’t remember what we put in for his employment, maybe just a letter from the company he was working for and a few photos of us together to show we had met. I would have thought that the fact that you have a child together is proof enough that your relationship is a genuine one. In your fresh application you should deal with any reasons for the refusal of your husband’s first visa and make sure that you provide any documentary evidence you may have so that the same reasons are not given for refusal again this time. I don’t think the fact that you are Council tenant should be reason enough on its own to refuse your husband a visa so long as you have a letter from the Council saying that the accommodation is big enough to house you all.

I agree with Prawo though that if it still doesn’t work out, you could live and work in another EU state for about six months and then exercise your Treaty rights to come back to the UK with your husband.
