Teir 2 and Want to Claim Tax Credit

Post by renno » Sun Jan 03, 2010 11:44 pm

Hello there,

I came to the UK on a work permit visa (for the past year), and now am on a Teir 2 residence permit for the coming 2 years. My wife does not work, and we just got a baby. I wanted to claim tax credit (and probably child credit).

Back in the US, I would get some of the tax back since my wife does not work, and I have a baby, so I am hoping this would be the same in the UK.

Does claiming tax credit affect a possible future application for an indefinite leave to remain?

Cheers,

Just to add to Wanderer's question, if you are a US citizen, before coming to the UK, did you ever work outside your country, for example, in Canada?

Also, your wife's nationality? And same question about work posed about her.

Thanks a lot for the replies,

Niether I nor my wife are US citizens. My reference to the US is because I studied there (was single), and am now married with a baby in the UK.

So can you please say which country you and your wife are citizens of? And if either/both of you worked in another country, prior to coming to the UK, details please.

Hello there,

We are both citizens of Lebanon. My wife used to work in Lebanon. I was a student in the US, and after marriage, we came to the UK. My wife does not work here; I only work. While in the US, I was only a student.

renno, thanks for that information, but sorry, for you and your wife, claiming Child Benefit and/or Tax Credits would be a breach of the "No recourse to Public Funds" restriction on your visas.

So you must not make any such claims.

But that visa restriction does not cut out everything. For example your child is clearly under 16, and is thus entitled to free NHS prescriptions and free NHS dentistry, as is your wife for one year starting with the date of her child's birth, assuming she was issued with the usual, I think it is called, "Certificate of Expected Confinement".

Dear John,

Thank you very much for the reply. I just wanted to know if I should try doing the paper work or not. That is perfectly fine.

Cheers,
