ILE visa predament

Post by jorobb » Tue Jan 05, 2010 3:53 pm

Hello all & happy new year

Don't know if anyone has any advice or has been through similar.
We (my USA spouse) and I + 4 pets are planning to move to the UK this year. We will have no jobs or sponsor just trying to get the visa on the basis or cash we will be bringing.

My dilemma is whether to apply for my spouse's visa ILE or to get the pets proccessing started which takes 6 months.
If we get all the pets sorted then my spouse's visa is refused it will have all been for nothing.
Or if we go the other way & get the ILE is there any plusses or minuses in waiting 6/8 months before travelling.
Any advice would really be appreciated

regards
Jo (USA)
If we start

What ties do you have to the UK for ILE to be issued?

No there are no pluse or minuses if you arrive 6-8 months late on ILE. If your case is straightforward it's probably best to get a move on regarding the pets.

However, are you a uk citizen?
I tell it like it is.

Thanks for the replies
Yes I am born & bred UK citizen. No family left there now so would be going home without sponsor or job just applying for ILE for US spouse on our savings. Again if there is a chance of the ILE being refused don't want to waste time & money on getting pets ready etc
Any advice please

If you have set up accommodation and have sufficient savings, there shouldn't be any reason for refusal (granted that you send sufficient proof of those two things). If you're truly worried, then hold off on the pets procedure. Like I said, you can take your time getting to the uk if your wife is granted ILE.

Your spouse can only apply for ILE if you have been married for a minimum of 4 years and living together for all of that time outside of the UK. If she hasn't passed the Life in the UK test (KOL) she will be issued with ILE(KOL Req), which will mean that after arriving in the UK and passing the KOL test she can then apply for ILR (a further 2 year visa).
If she visits the UK before applying for her spouse visa in the US, she can take the exam while she is here.
Do you consider your savings substantial and what arrangements will you make to show in your application that adequate accomodation will be available on your arrival for settlement?
I'm assuming that you're both over 21.

Thanks casa & others who have replied

Yes we are both over 21 (nearer to 60 now) & have been married & living together in the USA for 7 years.
As I said don't really know anyone in the UK now but with having no employment now here + no health insurance it's a no brainer for me to move back home.
Don't see how we can get accomidation back in the UK till we sell our house here & are ready to move. Are you saying we should perhaps go over & put maybe a 6 month deposit on a house rental before we apply for the ILE
That is why I am worried if the ILE will be refused if start the process now.
Again thanks for you help & patience etc

yes it's a good idea to secure some sort of accommodation before you apply. Also when you're there you can take the KOL test which is an ILE requirement.
