hello

i saw your post on immigation boards. could u help me with this query? how does one apply for discretionary leave to remain visa? what application form is required and how much is the application fee? i checked ukba website and found no application form. pls help

Discretionary leave can apply to certain type of application that you make, where you dont meet the essential criterias of that application.

You therefore ask the people in power to use their discretion to allow you to stay even though you dont meet the rules.

It very rarely happenes and when it does it is in the most extreme of special circumstances that you are allowed discretionary leave.

In plain English it means begging and grovelling to the powers in be to exempt you from the rules.

thanks for d reply. i am beginning to get a clearer picture of the application process.

does this mean there is no fee involved? should i just send all evidences with the letter or wait until requested? which address will i send to?

There could be a fee depending on what basis/application you are asking for DL.

Where you send it will once gain depend on what basis you are asking for DL and what form is used.Th eaddress wouldnormally on the form

Discretionary leave

If we do not recognise you as a refugee or a person who qualifies for humanitarian protection, we may give you another type of temporary permission to stay in the UK. This permission is called 'discretionary leave to remain'. How long you are allowed to stay will depend on your circumstances, but it is unlikely to be more than three years initially.

We will only give you discretionary leave to remain in limited circumstances. If you apply to renew it when it expires, we will review your circumstances before deciding whether to give you further permission to stay. See Active review for more details. You will not be able to apply for permanent residence until you have lived in the UK for at least six years (or 10 years in some cases). To extend your residence permit or apply for permanent residence, you will need to complete application form HPDL - see Extend your visa for more information.
