6 years descritionary leave to remain

Dear friends,

I been living in the UK since 2000.
I am married to British citizen since 2001 and have been given 02 years descritionary leave to remain each time since 2004.
I am gonna aply for setelement in the UK this month January 2010 when the 6 years is finish.

I saw 02 sollicitor :
One on legal aid and said that I just need to bring work documents ( pay slips) and banck statment for the last 03 month. No mention of any prouve of me and my wife living together. Because she said I am not gonna apply on the basic of marraige but on the basic of completion of 6 years descritionary leave to remain.

Another one (which I have to pay him £ 1000) insisted only on the prouve that me and my wife living together even when I mention about what the other solicitor said.
I am just totaly confused as what said one it totaly opposit what the other said and I don't know which one to choose.
I am living with my wife ofcourse.

My second question is I recently lost my passport her in the UK and I got police document to show that I declare the lost to the police. Is it will be a problem with the home office?

Hi robrob,
Just to say I am in exactly same situation as yours. I have applied already on 5th Jan for ILR after completion of 6 years DLR.

Please ring home office inquiries for form and documents needed. this is how i done mine.

You have to fill in SET(O) form, £820 fee, select other reasons category in the form and write that you were given 3lots of 2years discreationary leave on the basis of marriage to brit citizen and it has been completed.

You also have to write a letter to explain why do you think you should be given ILR? READ FORM.

You have to show minimum 6 documents - utility bills, council tax, tenancy agreement or whatever proof you can give for cohabitation for last 6 years. A recent photo of you and wife and kids if you have any will help.

UK living test is must if applicable.

Bank statements and pay slips.

this solicitor seems dodge to me. if you more questions youre welcome to ask.
